Insolvency and payment difficulties

Restructurings
Companies confronted with difficulties fulfilling their payment obligations can apply to the District Court for corporate restructuring in order to initiate special proceedings to reorganise their businesses. The Court will allow such proceedings provided that it may be presumed that the debtor is unable to pay its due debts and will not be able to do so in the near future.

Bankruptcies
If a natural or legal person becomes insolvent (i.e. is unable to pay debts as they fall due and this inability is not merely temporary), the natural or legal person is placed into bankruptcy by the court, either based on their own petition or the petition of a creditor.

Liquidations
The liquidation of a company entails the dissolution of a company or co-operative association. It can be voluntary or compulsory, such as where a limited company has no registered board of directors.

Dispute resolution

Dispute resolution includes matters relating to dispute resolution before courts of law and arbitration tribunals.

Financing

Financing companies undergoing difficulties, producing various solutions to procure capital or otherwise finance a particular business or business idea.

Property rights

Property rights include rules governing the manner in which holders of certain rights - such as title, security interests and rights of use - enjoy protection of such rights against claims from third parties.

Informal proceedings

Includes the restructuring of companies, by means of voluntary settlements and private settlements with creditors.
